Privacy Policy & Confidentiality Agreement

This Privacy Policy & Confidentiality Agreement ("Agreement") governs your use of Perfect Pitch's strategic intelligence services for agency pitches. Perfect Pitch is a trading name operated as a sole trader in the United Kingdom.

By using our services, you acknowledge that the materials you share with us are highly confidential and that mutual trust is essential to our relationship.

Part A: Privacy Policy

1. Information We Collect

We collect the following information:

• Account Information: Email address, agency name, contact details
• Pitch Materials: RFPs, briefs, tender documents, agency credentials decks in PDF, DOC, DOCX, TXT, and PPT formats
• Usage Data: How you interact with our service, accessed via cookies and analytics
• Payment Information: Processed securely through Stripe (we do not store card details)

2. How We Use Your Information

We use your information to:

• Generate your Perfect Pitch strategic intelligence reports
• Communicate service updates and deliver your reports
• Process payments
• Improve our service through anonymized analytics
• Send marketing communications (with your consent, which you may withdraw)

3. Data Storage and Retention

• Active Files: Your uploaded briefs are stored for 90 days with enterprise-grade security
• Archived Files: After 90 days, files are moved to encrypted archive storage for 2 years
• Reports: Your generated reports remain accessible indefinitely through your account
• Analytics: We may retain anonymized, aggregated data indefinitely for service improvement
• Account Deletion: Upon request, we will delete your personal data within 30 days, except where required by law (e.g., financial records retained for 6 years)

4. Third-Party Services

We use the following third-party services:

• Stripe: Payment processing (see Stripe's privacy policy)
• SendGrid: Automated email delivery for magic link authentication
• Google Analytics: Anonymous usage tracking (when implemented)

5. Data Security

We implement industry-standard security measures including:

• SSL/TLS encryption for all data in transit

• Enterprise-grade server security
• Access controls and authentication systems

• All pitch materials, briefs, RFPs, and strategic documents you upload
• Any proprietary information about your agency or clients
• The strategic analysis and insights we provide
• Any non-public information exchanged between us

10. Our Confidentiality Obligations

Perfect Pitch agrees to:

• Maintain strict confidentiality of all your uploaded materials
• Use your materials solely to provide the requested analysis
• Not disclose, share, or use your information for any other purpose
• Not discuss your specific briefs publicly without written permission from an authorized representative
• Implement reasonable security measures to protect your information

11. Your Confidentiality Obligations

You agree to:

• Only upload materials you have the right to share
• Maintain confidentiality of our proprietary methodologies
• Not reverse engineer our analytical processes
• Only share reports within your organization or with clients under similar confidentiality terms

12. Permitted Disclosures

Confidential Information may be disclosed only:

• With written consent from the disclosing party
• If required by law or court order (with prompt notice where permitted)
• To employees or contractors who need access and are bound by confidentiality

13. Duration of Confidentiality

Confidentiality obligations survive termination of your account and continue for 5 years, except for trade secrets which remain confidential indefinitely.

14. Anonymized Insights

We may use anonymized, aggregated insights for:

• Service improvement
• Industry trend reports
• Marketing (e.g., "analyzed 500+ briefs")

Such use will never identify you or your clients.

Part C: Additional Terms

15. Breach Notification

In the event of a data breach, we will:

• Notify the ICO within 72 hours where required
• Notify affected users without undue delay
• Provide details of the breach and mitigation steps

16. Children's Privacy

Our service is intended for users 18 and older. We do not knowingly collect data from minors.

17. Changes to This Agreement

We may update this Agreement with 30 days' notice via email. Continued use constitutes acceptance.
