1. Introduction
These Terms of Service ("Terms") govern your use of Perfect Pitch's strategic intelligence platform for agency pitches. By using our service, you agree to these Terms.
Perfect Pitch is a trading name operated as a sole trader in the United Kingdom. These Terms constitute a binding agreement between you and Perfect Pitch.
2. Service Description
Perfect Pitch provides strategic intelligence analysis for advertising, marketing, and creative agencies preparing competitive pitches. Our service includes:
- Analysis of uploaded pitch briefs, RFPs, and tender documents
- Generation of comprehensive reports containing 111+ strategic insights
- Nine modules addressing operational, strategic, and creative dimensions
- Secure platform access for report storage and retrieval
3. Account Registration
- You must be 18 years or older to use our service
- You must provide accurate, current information
- You are responsible for maintaining account security
- You must notify us immediately of any unauthorized access
- One account per individual (multi-user agency accounts coming soon)
4. Payment Terms
Pricing
- £350 per Perfect Pitch report
- Prices exclude VAT where applicable
- Payment required before report generation
Payment Methods
We accept payment via Stripe including:
- Credit and debit cards
- Apple Pay and Google Pay
Refunds
We stand behind our service quality. Refunds are available:
- Within 7 days if the analysis substantively fails to deliver the promised insights
- Within 30 days for technical issues preventing service delivery
- Refund requests must specify how the service failed to meet our published standards

5. Acceptable Use Policy
You agree NOT to:
- Upload materials you don't have rights to share
- Use the service for illegal activities in any applicable jurisdiction
- Upload content involving illegal activities
- Attempt to reverse engineer our methodologies
- Share login credentials with others
- Use the service to gather competitive intelligence on other agencies
- Abuse, harass, or harm others through the service
- Circumvent security measures or access restrictions
6. Intellectual Property
Your Content
- You retain all rights to materials you upload
- You grant us a limited license to process and analyze your materials
- You warrant you have the right to share uploaded materials
Our Content
Perfect Pitch owns all rights to:
- Generated reports and analyses
- Our methodologies and processes
- The platform and its functionality
You receive a license to use reports for your business purposes. You may share reports internally and with clients under confidentiality.
Restrictions
- No copying or distributing our methodologies
- No creating derivative works from our analytical frameworks
- No automated extraction or scraping
7. Service Guarantees and Disclaimers
What We Guarantee
- Delivery of comprehensive analysis within stated timeframes
- 111+ strategic insights across nine modules
- Professional-grade strategic intelligence
Important Disclaimers
- Our analysis is advisory only
- You remain responsible for your pitch strategy and execution
- We do not guarantee pitch wins
- You must independently verify information for your final pitch
- Service provided "as is" without warranty of specific outcomes
8. Limitation of Liability
Maximum Liability
Our total liability for any claim is limited to the amount paid for the specific report at issue (£350).
Exclusions
We are not liable for:
- Indirect, consequential, or punitive damages
- Lost profits or opportunities
- Pitch losses or client relationship issues
- Damages exceeding the fee paid for the relevant report
Indemnification
You agree to indemnify Perfect Pitch against claims arising from:
- Your breach of these Terms
- Your uploaded content
- Your use of our reports
9. Dispute Resolution
Disputes will be resolved through:
- Good faith negotiation (30 days)
- Mediation through CEDR (Centre for Effective Dispute Resolution)
- Legal proceedings in courts of England and Wales
Class Action Waiver
Where permitted by law, you waive the right to participate in class actions against Perfect Pitch.
10. Termination
By You
- Cancel your account anytime through the platform
- Existing reports remain accessible for 30 days
- No refunds for previously purchased reports
By Us
We may terminate accounts for:
- Violation of these Terms
- Non-payment
- Suspected fraudulent activity
- Extended inactivity
11. Communications
Service Communications
We may send:
- Report delivery notifications
- Security alerts
- Service updates
- Account information
Marketing Communications
- Only with your consent
- You may opt-out anytime while keeping your account
- Opt-out via email footer links or account settings
12. General Provisions
Entire Agreement
These Terms and our Privacy Policy & Confidentiality Agreement constitute the entire agreement.
Severability
If any provision is invalid, the remainder continues in effect.
No Waiver
Our failure to enforce any right is not a waiver.
Assignment
We may assign these Terms. You may not without our consent.
Force Majeure
Neither party is liable for delays due to circumstances beyond reasonable control.
13. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
14. Changes to Terms
We may update these Terms with 30 days' notice. Continued use after changes constitutes acceptance.
